WAIVER OF LIABILITY AND RENTAL POLICY

All patrons are required to sign this waiver before using the facility, in accordance with the State of Wisconsin and the Wisconsin Department of Natural Resources and in compliance with Wern Valley Outdoors.

Site members and annual members are required to complete or update their profile each year for easier access to the range.

I understand that participation in shooting sports and related range activities may be hazardous and involves risks that may result in personal injury, death, and/or loss of or damage to property. In consideration of being allowed to participate in activities at McMiller Sports Center, I, on behalf of myself and my heirs, successors, representatives, administrators, and assigns, agree to the following:

I waive, release, and forever discharge any and all past, present, or future claims, causes of action, suits, rights, damages, costs, expenses, obligations, and demands of any kind whatsoever that I, or anyone acting on my behalf, may have against McMiller Sports Center, Wern Valley Outdoors Inc., and the Wisconsin Department of Natural Resources, and each of their parent companies, affiliates, subsidiaries, successors, officers, directors, employees, agents, representatives, contractors, and volunteers, arising out of or related to my participation in shooting activities or presence at the facility, including but not limited to claims for personal injury, death, or property damage, to the fullest extent permitted by law.

I agree to indemnify, defend, and hold harmless McMiller Sports Center, Wern Valley Outdoors Inc., and the Wisconsin Department of Natural Resources from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses, including reasonable attorney fees, arising out of or related in any way to my participation in activities at the facility, my use of any rental equipment, or my violation of range rules or safety procedures.

I voluntarily assume all risks associated with these activities and accept full responsibility for any medical expenses, emergency services, property loss, or other costs or obligations arising from my participation in activities at McMiller Sports Center.

Firearm Safety Acknowledgment

Anyone who uses a firearm has a responsibility to themselves and others to use the firearm safely. I affirm that I am familiar with the basic rules of firearm safety, that those rules have been explained to me, and that I will follow all firearm and range safety rules at all times while using or handling any firearm.

• I will treat every firearm as if it were loaded.

• I will always keep the firearm pointed in a safe direction.

• I will not place my finger on the trigger or inside the trigger guard unless and until I am ready to fire.

• I will always wear appropriate eye and ear protection.

• I will never pass a firearm to another person without opening and keeping open the cylinder or action to verify that it is unloaded.

• I will always follow the commands of the Range Officer and the management of McMiller Sports Center.

Range Use Policy

I agree to use the facility safely, lawfully, and only as directed by staff. No drones, videos, or photographs are allowed on the ranges except with prior permission from McMiller Sports Center management. McMiller Sports Center reserves the right to remove any patron from the facility or deny range access at any time for unsafe conduct, rule violations, or any reason deemed necessary by staff.

Rental Agreement

• I understand and agree that any McMiller Sports Center rental must remain in my care and custody and may not leave the property. Removal of rental property, including firearms, bows, arrows, scopes, lead sleds, and cases, is strictly prohibited.

• I agree to return all rental property to McMiller Sports Center before the close of business on the same day the rental begins unless otherwise approved in writing by management. Failure to return rental property may result in legal action.

• I agree to attend a safety handling demonstration before using any McMiller Sports Center rental item, including firearms, bows, arrows, scopes, and lead sleds. I acknowledge that ammunition or arrows required for rental use must be purchased separately unless otherwise stated by McMiller Sports Center.

• I certify that I may lawfully possess a firearm in the State of Wisconsin, if applicable. I understand that any rental item may be removed from my custody at any time by McMiller Sports Center staff for safety, policy, or operational reasons. I also understand that I am responsible for damage to rental property and may be charged the full replacement cost if an item is lost, stolen, or damaged.

Participant Acknowledgment and Signatures

If the participant is under 18 years of age, a parent or legal guardian must also sign below. By signing participation and legal guardian acknowledges that they have read this waiver, consent to the minor's participation, and agree individually and on behalf of the minor to all terms of this Waiver of Liability and Rental Policy.
